TERMS AND CONDITIONS


 

I (THE OWNER) agree that by enrolling my dog(s) at and entrusting my dog(s) to the care of K9 Anytime; - 

  1. I confirm that I accept these terms and conditions and agree to be bound by them.

  2. I confirm that I am the legal owner of any dog that I enrol with K9 Anytime and that this Agreement will apply to all or any dog(s) that I enrol and that I am able to enter into this Agreement and do so in all ways to bind myself to the terms hereof.

  3. That I will, in addition to the specific terms of my Agreement with K9 Anytime, agree to at all times abide by such reasonable rules and regulations and conditions as may be imposed by K9 Anytime.

  4. I understand that K9 Anytime is an open plan, cage free environment and that my dog(s) will socialise with other dogs and humans whilst in the care and control of K9 Anytime.

  5. I agree that my dog(s) can partake in any and all activities at K9 Anytime, and that I shall BEFORE delivering my dog(s) into the care of K9 Anytime expressly detail IN WRITING any activities in which I do not wish my dog(s) to partake.

  6. I acknowledge that dogs can be unpredictable and I recognise and accept the obvious risks involved with my dog(s) attending K9 Anytime and that K9 Anytime cannot be expected to foresee all eventualities regarding the care and accommodation of dogs.

  7. I hereby give my consent to K9 Anytime taking any reasonable action deemed necessary to maintain and ensure the happiness, safety, security, protection, health and well being of my dog(s) and all or any other dogs, whilst in their care, either directly or indirectly, and to ensure the happiness, safety, security, protection, health and well being of all or any visitors, staff, clients, servants or agents of K9 Anytime.

  8. I agree that I shall indemnify K9 Anytime, its representatives and employees, servants or agents against any injury or illness my dog(s) sustains or causes while at K9 Anytime.

  9. I agree that by way of summary but subject to the detailed provisions set out below, that K9 Anytime may act in my absence as guardian of my dog and may perform or take any action which they deem necessary in order to protect and keep in good health my dog.

 

  1. MY DOG(S)

  1. I confirm that all information about my dog(s) provided by me is true. If I have provided false or misleading information, or if I have failed to provide or withheld relevant information, K9 Anytime accepts no responsibility for any consequential harm sustained to or caused by my dog(s) as a result, and will instantly dismiss my dog(s) without refund.

  2. I confirm that all or any dogs that I entrust to the care of K9 Anytime are over 6 months of age.

  3. I confirm that my dog(s) is suitable and able to socialise with other dogs and humans and that I have no reason to believe that my dog(s) is in any way unsuited to being in the care of K9 Anytime and for inclusion in any of its programmes.

  4. I confirm that my male dog(s) has been neutered and I will provide proof of this before my dog(s) attends K9 Anytime. I understand that my female dog(s) does not have to have been spayed, but that they are strictly NOT to attend K9 Anytime when they are in season. I understand that it is exclusively my responsibility to monitor when my dog is in season and when she cannot attend. 

  5. I shall expressly detail in writing any and all of my dog(s) characteristics which could pose any risk, threat or danger to itself, other dogs, staff at or visitors to K9 Anytime before delivering my dog(s) into the care of K9 Anytime on each and every occasion that my dog(s) is delivered. I agree that in the absence of any such notification in writing that K9 Anytime may assume that there are no relevant characteristics.

  6. I understand that K9 Anytime reserves the right to instantly dismiss my dog(s) from K9 Anytime without refund should they behave in any way unsuitably, dangerously or inappropriately, in the event of which I and in turn my Emergency Contact(s) will be contacted and will collect my dog(s) immediately from the premises. I understand I will not be reimbursed for early collection of my dog(s) from K9 Anytime in these instances.

  7. I understand that my dog(s) must first attend a pre-play induction where K9 Anytime will determine whether my dog(s) is suitable for the establishment and regime and whether the establishment and regime is suitable for my dog(s). I understand that K9 Anytime reserves the right to refuse my dog(s) admission if they believe my dog(s) to be unsuitable to attend the establishment for any reason and that the decision of K9 Anytime will be absolute.

  8. I understand that in the event of unsuitable, dangerous or inappropriate behaviour, my dog will be held in a designated area alone until I or my Emergency Contact(s) collect them from the premises.

  9. Any dispute regarding any incident occurring between dogs at K9 Anytime must be taken directly to the owner of the dog in question.

 

  1. COLLARS

  1. I understand that my dog(s) must arrive at K9 Anytime on a lead and remain on a lead until I am instructed otherwise by a member of staff at K9 Anytime.

  2. I give my consent for K9 Anytime to use their own leads for my dog(s) at any time during their stay.

  3. I understand that my dog(s) must be wearing a flat collar with a name tag during any visit to K9 Anytime.

 

  1. PHOTOGRAPHIC CONSENT 

I give my consent for photo or video content of my dog(s) including their name and personal information to be published on K9 Anytime’s social media channels and website and to be used in K9 Anytime’s marketing, promotional or any such other material.

 

  1. EMERGENCY CONTACTS

  1. I confirm that the persons I have named in writing to K9 Anytime as Emergency Contacts are the persons who will act in my absence should I be unable to collect or make immediate or emergency decisions about or for my dog(s). 

  2. I understand that K9 Anytime will under no circumstances hand over my dog(s) to any individual other than myself who is not named in my Emergency Contacts. I agree that in the event of my dog(s) being collected from K9 Anytime by an Emergency Contact, K9 Anytime accepts no responsibility for my dog(s) once it has left the premises.

  3. I confirm that if I need to change or add a further person(s) to my Emergency Contacts list for any reason at any time I will do so immediately and in writing. In the absence of such formal written notification then the Emergency Contact(s) whom I have nominated will remain responsible.

  4. I confirm that I will notify all persons named by me as Emergency Contacts of their nomination and that in providing their names to K9 Anytime I confirm that they have understood and agreed to this role and its responsibilities.

  5. I understand that if at any time neither I or any of my Emergency Contacts are available to collect my dog(s) or act on their behalf, then K9 Anytime will keep my dog(s) at the premises and charge for any additional time spent there until they are collected, and I confirm that K9 Anytime may take any and all actions they deem necessary to care for my dog(s) in the absence of myself and my Emergency Contacts.

  6. I confirm that I will pay for all charges incurred as a result of the absence of myself and my Emergency Contacts before my dog(s) leaves the K9 Anytime premises.


 

  1. MEDICAL HEALTH

  1. I confirm that my dog(s) has been vaccinated against kennel cough and I confirm that my dog(s) will at all times be properly inoculated and maintained in good and proper and safe health to a standard suitable for my dog(s) to be in the close company of other dogs.

  2. I will provide up to date proof of vaccinations to K9 Anytime on enrolment and will keep up to date with any and all necessary boosters and annual or other periodic renewals or additional vaccinations. I will provide this to K9 Anytime at any time upon request in order for them to keep their records up to date.

  3. I confirm that I will keep my dog de-flead, de-wormed and fully vaccinated. I understand that K9 Anytime takes no responsibility for the contraction of any disease, infection, illness or pest while my dog(s) is at K9 Anytime.

  4. I understand that my dog’s vaccinations must be given at least 2 weeks prior to attendance and that if my dog(s) is not sufficiently vaccinated they will not be accepted to attend K9 Anytime.

  5. I understand that my dog(s) will be unable to attend K9 Anytime if it is unwell and that K9 Anytime reserves the right to refuse my dog(s) admission to the premises should they have any concern that my dog’s current health or state might be in any way likely to cause any upset, illness or injury to any other dog(s) or person(s) or pose any risk to other dogs or staff at K9 Anytime.

  6. I confirm that my dog(s) has not been ill with any contagious disease or condition within the past thirty (30) days. 

  7. I confirm that my dog(s) is suitably fit and well and I have made K9 Anytime aware of any current conditions, allergies or medication that is being taken. 

  8. I confirm that my dog(s) is fully insured under a pet insurance policy, and that I will notify my insurers of my dog's attendance at K9 Anytime and ensure that my policy covers this. I shall provide a copy of this insurance policy to K9 Anytime upon request. 

  9. I understand that K9 Anytime does not accept liability for any disease incubating, including kennel cough, or natural death that occurs.

  10. I understand that K9 Anytime reserves the right to call animal welfare services should they be concerned about the general welfare of my dog(s) or my ability to care for my dog(s).

 

  1. VETERINARY CARE

  1. I authorise K9 Anytime to contact my Vet in order to obtain medical or behavioural advice or history relating to my dog(s) should the need arise and I confirm that I shall advise and authorise my Vet accordingly.

  2. Full details of my chosen Vet will be provided to K9 Anytime and all or any amendments to my chosen Vet will be notified to them in writing. 

  3. If any issues arise whilst my dog(s) is in the care of K9 Anytime and I or my designated Emergency Contacts cannot be contacted, or if time does not permit such contact in case of an emergency, then I authorise K9 Anytime to do whatever they deem necessary for the happiness, safety, security, protection, health and wellbeing of my dog(s). I authorise K9 Anytime to contact my Vet or should that not be possible or timely for any reason then a Vet chosen by K9 Anytime and I hereby give consent to any examination, investigation or treatment for the well being of my dog(s) being undertaken at the absolute discretion of K9 Anytime and I agree to assume full financial responsibility for any and all expenses incurred, which will be paid by me prior to my dog(s) leaving the premises.

  4. I acknowledge that K9 Anytime will administer routine medication free of charge, unless the administering of medication proves to put my dog(s) or K9 Anytime’s staff in any danger or discomfort, in which case I give my consent that K9 Anytime instruct my nominated Vet, or in the event that such contact would not be possible or timely then to instruct a Vet chosen by themselves to administer the medication and I accept that any veterinary fees incurred will be paid by me prior to my dog(s) leaving the premises. 

  5. I understand that K9 Anytime will not administer any medication by injection and that my dog(s) will be taken to my own nominated Vet or to K9 Anytime's chosen Vet in the event of injections being necessary. I confirm that all or any fees incurred will be paid by me prior to my dog(s) leaving the premises. 

  6. I also agree that should K9 Anytime have to provide or engage any person or persons at any time to accompany my dog(s) to medical or other appointments then I shall be responsible for the reasonable costs of them doing so.

 

  1. LIABILITY

  1. I understand that my dog(s) will be monitored by staff at all times when at K9 Anytime, but I acknowledge that unforeseen accidents and incidents can occur. I understand that K9 Anytime cannot predict nor control every movement during communal activity and that as such K9 Anytime cannot and will not be responsible for any accidents and incidents that might occur.

  2. I confirm that I will be responsible for any loss or damage arising, either to my own dog(s) or to the business of K9 Anytime, other domestic animals on the premises (whether in their care or not) and all or any humans.

  3. I understand that the cost of any and all damage my dog(s) sustains or causes during their stay will be added to my account and paid by me before my dog(s) leave the premises.

  4. I understand that under no circumstances will K9 Anytime be liable for consequential damages to or damages beyond the replacement value of my dog(s). I expressly waive and relinquish any and all claims beyond that limitation against K9 Anytime, its employees and representatives, servants or agents save and except those arising from negligence on the part of K9 Anytime.

  5. I understand that K9 Anytime will take no responsibility for any loss, damage, harm, illness or injury my dog(s) sustains from or causes to itself, other dogs or humans, or any loss, damage, harm, illness or injury my dog(s) sustains from the K9 Anytime premises and its contents save as may be attributable directly to gross negligence of K9 Anytime. 

  6. Subject to clause (7d) and without prejudice to all or any other terms and conditions set out, K9 Anytime's total liability to me, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Agreement shall be limited to £1,000 or the total fees paid under the Agreement, whichever is lower.

  7. This clause (7f) shall survive termination of the Agreement, however terminated.

  8. I confirm that I have in place current liability insurance for my dog(s) under a pet insurance policy (either by way of free standing insurance policy or by inclusion in a home and property contents insurance policy) and that I have notified my insurers of my Agreement with K9 Anytime (and in particular of the terms of this section) in order to be covered under the pertinent insurance policies. If at any time this insurance lapses or is invalidated or expires or is in any other way no longer effective then I shall notify K9 Anytime accordingly and will not leave my dog(s) in the care of K9 Anytime until such time as I can confirm that such cover is in place.

  9. I am aware that the K9 Anytime premises is fully secured by 5ft fencing and whilst K9 Anytime will make every effort to ensure that all dogs remain safely contained within the premises I understand that K9 Anytime cannot and will not  accept responsibility should my dog(s) escape or run away from the premises.

  10. I understand that K9 Anytime is not responsible for any loss, injury, death, disease or illness my dog(s) sustains from or causes to itself, other dogs or humans. I understand that K9 Anytime is not responsible for infections, viruses, accidents, fights, falls, theft, collisions, escape or running away from the premises, collisions with vehicles, natural disasters, fire, the negligence or deliberate acts of third parties.

  11. I confirm that any personal property I leave at K9 Anytime will be clearly named. I understand that K9 Anytime is not responsible for any loss of or damage to personal property I choose to leave at K9 Anytime. Uncollected items will be disposed of if not collected within 2 weeks of the departure date. 

 

  1. PAYMENT

  1. The costs of care for my dog(s) at K9 Anytime will be as advertised or as otherwise agreed with K9 Anytime in writing.

  2. K9 Anytime accepts payment in cash, by credit or debit card. K9 Anytime does not accept cheques and a charge will be added to payments by credit card.

  3. All or any incidental costs arising out of the reasonable care of my dog(s) by K9 Anytime (whether provided for in the Agreement or whether arising as a result of the reasonable care of my dog(s) by K9 Anytime) will be payable by me before my dog(s) leaves the care of K9 Anytime.

  4. I confirm that I will pay for my dog’s stay at K9 Anytime when I deliver my dog(s) on that day. I understand that if I am unable to pay I will be unable to leave my dog(s) at K9 Anytime.

  5. I agree to pay any and all costs incurred by K9 Anytime by, for or on behalf of my dog(s) on the day that they are incurred and before my dog(s) leaves the K9 Anytime premises. I acknowledge that these fees may include but are not limited to the costs of dealing with illness or injury my dog(s) sustains from or causes to itself, other dogs or humans, damages my dog(s) sustains from the K9 Anytime premises and its contents, veterinary bills, transportation costs, and all other costs reasonably incurred by K9 Anytime.

  6. I understand that I will not be refunded if I collect my dog(s) early for any reason unless otherwise agreed in writing.

  7. On termination of any Agreement for any reason I agree that I shall immediately pay all or any outstanding unpaid costs and, in respect of services supplied but for which no invoice has been submitted, then I will pay the same within 7 days of receipt of an invoice.

  8. I agree that I shall pay all amounts due under the Agreement in full without any set-off, counterclaim, deduction or withholding (except for any deduction or withholding required by law). 

  9. I understand that K9 Anytime reserves the right to rehome my dog(s) if it is not collected within 7 days from the agreed collection date if no written correspondence has been received and/or if payment has not been received. I shall still remain responsible for all or any costs or charges or liabilities in connection with any such rehoming in addition to all or any other costs or charges or liabilities arising from the care of my dog by K9 Anytime both in this regard and under the Agreement generally.

  11. GENERAL 

  12. I confirm that this Agreement and its contents is the entire and only agreement between myself and K9 Anytime. If there are to be any further or additional agreements between myself and K9 Anytime, these will only come into effect if, as and when they have been put into writing and signed by both parties.

  13. I agree that I have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this Agreement.

  14. If I have not used K9 Anytime’s services for 3 days or longer, I am unable to make any claims against K9 Anytime.

  15. Any waiver of any right or remedy by K9 Anytime shall only be effective if given in writing and shall not be deemed a waiver of any other breach or default.  Any delay or failure to exercise, or partially exercise, any right or remedy shall not     

(i)      waive that or any other right or remedy; or

(ii)    prevent or restrict the further exercise of that or any other right or remedy.

  1. Should it at any time be considered or decided that any provision (whether in whole or in part) of this Agreement is or becomes invalid, illegal or unenforceable, then it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, and the relevant provision or part-provision shall be deleted, then any such deletion of a provision or part-provision (or modification as provided for ) under this clause shall not affect the validity and enforceability of the rest of the Agreement.

  3. Any notice or other communication given to a party under or in connection with this  Agreement shall be in writing, addressed to that party at its registered office or such other address as that party may have specified to the other party in writing, and shall be delivered personally, or sent by pre-paid first class post or other next working day delivery service, commercial courier, fax or email to the correctly addressed email address.
    A notice or other communication shall be deemed to have been received: if delivered personally, when left at the Client’s address provided by him/her; if sent by pre-paid first class post or other next working day delivery service to the same address, at 9.00 am on the second business day after posting; if delivered by commercial courier, on the date and at the time that the courier's delivery receipt is signed; or, if sent by fax or email one business day after transmission.

  4. The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.

  5. No one other than a party to this Agreement shall have any right to enforce any of its terms.

  6. The Agreement, any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

 

I confirm that I have read carefully and fully understand all of the above and agree to be bound by this Agreement.

I (THE OWNER) agree that by enrolling my dog(s) at and entrusting my dog(s) to the care of K9 Anytime; - 

  1. I confirm that I accept these terms and conditions and agree to be bound by them.

  2. I confirm that I am the legal owner of any dog that I enrol with K9 Anytime and that this Agreement will apply to all or any dog(s) that I enrol and that I am able to enter into this Agreement and do so in all ways to bind myself to the terms hereof.

  3. That I will, in addition to the specific terms of my Agreement with K9 Anytime, agree to at all times abide by such reasonable rules and regulations and conditions as may be imposed by K9 Anytime.

  4. Where two or more of my dogs are sharing a bedroom, I accept responsibility for any incidents that occur due to this request and I understand that K9 Anytime reserves the right to board these dogs separately and charge separate room rates should any problems arise during their stay. 

  5. I hereby give my consent to K9 Anytime taking any reasonable action deemed necessary to maintain and ensure the happiness, safety, security, protection, health and well being of my dog(s) and all or any other dogs, whilst in their care, either directly or indirectly, and to ensure the happiness, safety, security, protection, health and well being of all or any visitors, staff, clients, servants or agents of K9 Anytime.

  6. I agree that I shall indemnify K9 Anytime, its representatives and employees, servants or agents against any injury or illness my dog(s) sustains or causes while at K9 Anytime.

  7. I agree that by way of summary but subject to the detailed provisions set out below, that K9 Anytime may act in my absence as guardian of my dog and may perform or take any action which they deem necessary in order to protect and keep in good health my dog.

 

  1. MY DOG(S)

I agree that in the absence of any such notification in writing that K9 Anytime may assume that there are no relevant characteristics.

  5. I understand that K9 Anytime reserves the right to instantly dismiss my dog(s) from K9 Anytime without refund should they behave in any way unsuitably, dangerously or inappropriately, in the event of which I and in turn my Emergency Contact(s) will be contacted and will collect my dog(s) immediately from the premises. I understand I will not be reimbursed for early collection of my dog(s) from K9 Anytime in these instances.

  6. I understand that K9 Anytime reserves the right to refuse my dog(s) admission if they believe my dog(s) to be unsuitable to attend the establishment for any reason and that the decision of K9 Anytime will be absolute.

  1. Food

I understand that I must provide enough food for two meals per day for every day of my dog’s stay at K9 Anytime. If I do not provide enough food to cover the entirety of their stay, I understand that I will cover all costs incurred by K9 Anytime in providing food for my dog(s). I understand that if K9 Anytime have to provide food for my dog(s), they will source the same dog food I have provided or the nearest possible alternative.

 

  1. PHOTOGRAPHIC CONSENT

  1. VETERINARY CARE

  1. I authorise K9 Anytime to contact my Vet in order to obtain medical or behavioural advice or history relating to my dog(s) should the need arise and I confirm that I shall advise and authorise my Vet accordingly.

  2. Full details of my chosen Vet will be provided to K9 Anytime and all or any amendments to my chosen Vet will be notified to them in writing. 

  3. If any issues arise whilst my dog(s) is in the care of K9 Anytime and I or my designated Emergency Contacts cannot be contacted, or if time does not permit such contact in case of an emergency, then I authorise K9 Anytime to do whatever they deem necessary for the happiness, safety, security, protection, health and wellbeing of my dog(s). I authorise K9 Anytime to contact my Vet or should that not be possible or timely for any reason then a Vet chosen by K9 Anytime and I hereby give consent to any examination, investigation or treatment for the well being of my dog(s) being undertaken at the absolute discretion of K9 Anytime and I agree to assume full financial responsibility for any and all expenses incurred, which will be paid by me prior to my dog(s) leaving the premises.

  4. I acknowledge that K9 Anytime will administer routine medication free of charge, unless the administering of medication proves to put my dog(s) or K9 Anytime’s staff in any danger or discomfort, in which case I give my consent that K9 Anytime instruct my nominated Vet, or in the event that such contact would not be possible or timely then to instruct a Vet chosen by themselves to administer the medication and I accept that any veterinary fees incurred will be paid by me prior to my dog(s) leaving the premises. 

  5. I understand that K9 Anytime will not administer any medication by injection and that my dog(s) will be taken to my own nominated Vet or to K9 Anytime's chosen Vet in the event of injections being necessary. I confirm that all or any fees incurred will be paid by me prior to my dog(s) leaving the premises. 

  6. I also agree that should K9 Anytime have to provide or engage any person or persons at any time to accompany my dog(s) to medical or other appointments then I shall be responsible for the reasonable costs of them doing so.

 

  1. LIABILITY

  1. I acknowledge that unforeseen accidents and incidents can occur. I understand that K9 Anytime cannot predict nor control my dog’s every movement and that as such K9 Anytime cannot and will not be responsible for any accidents and incidents that might occur.

  2. Where two or more of my dogs are sharing a bedroom, I accept responsibility for any incidents that occur due to this request and I understand that K9 Anytime reserves the right to board these dogs separately and charge separate room rates should any problems arise during their stay. 

  3. I confirm that I will be responsible for any loss or damage arising, either to my own dog(s) or to the business of K9 Anytime, other domestic animals on the premises (whether in their care or not) and all or any humans.

  4. I understand that the cost of any and all damage my dog(s) sustains or causes during their stay will be added to my account and paid by me before my dog(s) leave the premises.

  5. I understand that under no circumstances will K9 Anytime be liable for consequential damages to or damages beyond the replacement value of my dog(s). I expressly waive and relinquish any and all claims beyond that limitation against K9 Anytime, its employees and representatives, servants or agents save and except those arising from negligence on the part of K9 Anytime.

  6. I understand that K9 Anytime will take no responsibility for any loss, damage, harm, illness or injury my dog(s) sustains from or causes to itself, other dogs or humans, or any loss, damage, harm, illness or injury my dog(s) sustains from the K9 Anytime premises and its contents save as may be attributable directly to gross negligence of K9 Anytime. 

  7. Subject to clause (7d) and without prejudice to all or any other terms and conditions set out, K9 Anytime's total liability to me, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Agreement shall be limited to £1,000 or the total fees paid under the Agreement, whichever is lower.

  8. This clause (7f) shall survive termination of the Agreement, however terminated.

  9. I  confirm that I have in place current liability insurance for my dog(s) under a pet insurance policy (either by way of free standing insurance policy or by inclusion in a home and property contents insurance policy) and that I have notified my insurers of my Agreement with K9 Anytime (and in particular of the terms of this section) in order to be covered under the pertinent insurance policies. If at any time this insurance lapses or is invalidated or expires or is in any other way no longer effective then I shall notify K9 Anytime accordingly and will not leave my dog(s) in the care of K9 Anytime until such time as I can confirm that such cover is in place.

  10. I am aware that the K9 Anytime premises is fully secured by 5ft fencing and whilst K9 Anytime will make every effort to ensure that all dogs remain safely contained within the premises I understand that K9 Anytime cannot and will not accept responsibility should my dog(s) escape or run away from the premises.

  11. I understand that K9 Anytime is not responsible for any loss, injury, death, disease or illness my dog(s) sustains from or causes to itself, other dogs or humans. I understand that K9 Anytime is not responsible for infections, viruses, accidents, fights, falls, theft, collisions, escape or running away from the premises, collisions with vehicles, natural disasters, fire, the negligence or deliberate acts of third parties.

  12. I confirm that any personal property I leave at K9 Anytime will be clearly named. I understand that K9 Anytime is not responsible for any loss of or damage to personal property I choose to leave at K9 Anytime. Uncollected items will be disposed of if not collected within 2 weeks of the departure date. 

 

  1. PAYMENT

  1. The costs of care for my dog(s) at K9 Anytime will be as advertised or as otherwise agreed with K9 Anytime in writing.

  2. K9 Anytime accepts payment in cash, by credit or debit card. K9 Anytime does not accept cheques and a charge will be added to payments by credit card.

  3. All or any incidental costs arising out of the reasonable care of my dog(s) by K9 Anytime (whether provided for in the Agreement or whether arising as a result of the reasonable care of my dog(s) by K9 Anytime) will be payable by me before my dog(s) leaves the care of K9 Anytime.

  4. I understand that K9 Anytime does not accept provisional bookings and that I will pay a non-refundable non-transferable 50% deposit of the total amount for my dog’s stay at K9 Anytime Luxury Hotel upon booking, and I will pay the remaining 50% upon check-in at the very latest. I understand that if I am unable to pay I will be unable to leave my dog(s) at K9 Anytime.

  5. I agree to pay any and all costs incurred by K9 Anytime by, for or on behalf of my dog(s) on the day that they are incurred and before my dog(s) leaves the K9 Anytime premises. I acknowledge that these fees may include but are not limited to the costs of dealing with illness or injury my dog(s) sustains from or causes to itself, other dogs or humans, damages my dog(s) sustains from the K9 Anytime premises and its contents, veterinary bills, transportation costs, and all other costs reasonably incurred by K9 Anytime.

  6. I understand that I will not be refunded if I collect my dog(s) early for any reason unless otherwise agreed in writing.

  7. On termination of any Agreement for any reason I agree that I shall immediately pay all or any outstanding unpaid costs and, in respect of services supplied but for which no invoice has been submitted, then I will pay the same within 7 days of receipt of an invoice.

  8. I agree that I shall pay all amounts due under the Agreement in full without any set-off, counterclaim, deduction or withholding (except for any deduction or withholding required by law). 

  9. I understand that K9 Anytime reserves the right to rehome my dog(s) if it is not collected within 7 days from the agreed collection date if no written correspondence has been received and/or if payment has not been received. I shall still remain responsible for all or any costs or charges or liabilities in connection with any such rehoming in addition to all or any other costs or charges or liabilities arising from the care of my dog by K9 Anytime both in this regard and under the Agreement generally.

  11. GENERAL 

  12. I confirm that this Agreement and its contents is the entire and only agreement between myself and K9 Anytime. If there are to be any further or additional agreements between myself and K9 Anytime, these will only come into effect if, as and when they have been put into writing and signed by both parties.

  13. I agree that I have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this Agreement.

  14. If I have not used K9 Anytime’s services for 3 days or longer, I am unable to make any claims against K9 Anytime.

  15. Any waiver of any right or remedy by K9 Anytime shall only be effective if given in writing and shall not be deemed a waiver of any other breach or default.  Any delay or failure to exercise, or partially exercise, any right or remedy shall not     

(i)      waive that or any other right or remedy; or

(ii)    prevent or restrict the further exercise of that or any other right or remedy.

  1. Should it at any time be considered or decided that any provision (whether in whole or in part) of this Agreement is or becomes invalid, illegal or unenforceable, then it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, and the relevant provision or part-provision shall be deleted, then any such deletion of a provision or part-provision (or modification as provided for ) under this clause shall not affect the validity and enforceability of the rest of the Agreement.

  2. Any notice or other communication given to a party under or in connection with this  Agreement shall be in writing, addressed to that party at its registered office or such other address as that party may have specified to the other party in writing, and shall be delivered personally, or sent by pre-paid first class post or other next working day delivery service, commercial courier, fax or email to the correctly addressed email address.
    A notice or other communication shall be deemed to have been received: if delivered personally, when left at the Client’s address provided by him/her; if sent by pre-paid first class post or other next working day delivery service to the same address, at 9.00 am on the second business day after posting; if delivered by commercial courier, on the date and at the time that the courier's delivery receipt is signed; or, if sent by fax or email one business day after transmission.

  3. The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.

  4. No one other than a party to this Agreement shall have any right to enforce any of its terms.

  5. The Agreement, any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

 

I confirm that I have read carefully and fully understand all of the above and agree to be bound by this Agreement.
